Jamie Stephanie Guilford worked for Secure Data Technologies, Inc. from July 9, 2018 to February 23, 2020.
During that period she held the title of salaried Senior Consulting System Engineer.
Her responsibilities included interfacing with the company’s client base and working on wireless, security and data center design, setup and integration. Secure Data Technologies, Inc. is an Illinois corporation that provides clients with hardware, software, managed services and professional services in four areas: Collaboration, Data Center, Network and Security.
Upon hiring in 2018 she signed a non‑compete agreement with Secure Data Technologies.
In February 2020 Secure Data Technologies reported a security alert after detecting unusual activity in its email system.
An investigation of the activity log revealed that Guilford had granted herself unapproved access to the mailboxes of CEO Dana Steffey, CFO Derek Herbison, employee Simonne Meszaros and one other Secure Data employee.
The complaint alleges that she used this access to review sensitive emails exchanged among the company’s management team.
As a result of the alleged misconduct Guilford was terminated from Secure Data Technologies.
The plaintiff submitted an alleged admission by Guilford stating that she illegally hacked into Secure Data’s confidential emails, which was attached to the lawsuit as an exhibit. After her departure Guilford formed Guilford Technologies, LLC, where she serves as CEO and registered agent, and positioned it as a direct competitor offering consultative infrastructure technology services.
The lawsuit claims that Guilford Technologies solicited one of Secure Data’s lucrative clients, Tacony Corporation, using proprietary client information allegedly misappropriated from Secure Data.
It is alleged that Guilford improperly offered services to Tacony, and that her involvement coincided with a loss of expected revenue from that relationship for Secure Data.
Additionally, a Secure Data employee conducting a daily review of Tacony’s infrastructure noticed that information regarding Jamie Guilford was added after her departure, an observation made in August around the time Secure Data detected a change in its relationship with Tacony.
Secure Data accuses Guilford of breaching the non‑compete agreement by appropriating proprietary client information related to Tacony, forming a competing company, soliciting and contracting with Secure Data clients, using Secure Data’s confidential information to compete against it, and sharing that information with Guilford Technologies LLC. For these alleged transgressions the plaintiff seeks preliminary and permanent injunctions to prevent further disclosure or use of the trade secrets Guilford is accused of having misappropriated, as well as monetary damages for breach of contract, confidential data misuse and competitive interference.
The plaintiff is represented by Avigad Law, LLC.
The case is filed in the Eastern District of Missouri and asserts seven claims for relief under various Missouri and Illinois business tort and computer fraud statutes.
